Cancellation/Refund Policy

This Cancellation/Refund Policy outlines the terms and conditions for the cancellation of services and the processing of refunds by Tesberry Pvt Ltd ("Tesberry," "we," "us," or "our"). This policy is designed to ensure clarity and fairness for all our clients while accounting for the customized nature of our digital transformation solutions.

1. General Principles: Given the bespoke and resource-intensive nature of custom software development, AI integration, web/mobile app development, and strategic digital marketing, our services often involve significant upfront planning, resource allocation, and specialized expertise. Therefore, cancellation and refund eligibility are subject to the progress of work, incurred costs, and specific terms outlined in your project's Service Agreement or Statement of Work (SOW).

2. Cancellation of Services:

  • Initial Cancellation Window: Clients may initiate a cancellation request within seven (7) calendar days from the date of the signed Service Agreement or the date of the initial payment, whichever occurs first. To be valid, a cancellation request must be submitted in writing via email to info@tesberry.com. The email should clearly state the intention to cancel, along with the project reference number or client name.

  • Post-Initial Window Cancellation: For cancellation requests made after the initial seven (7) calendar days, the terms and conditions for termination as specified in the individual Service Agreement or SOW for your project will apply. This typically involves charges for all work completed up to the date of cancellation, along with any non-recoverable costs (e.g., third-party licenses, pre-paid services, committed resources).

  • Project Specific Agreements: Certain projects, especially those involving significant upfront investment, long-term commitments, or highly specialized resources, may have unique cancellation clauses stipulated in their respective Service Agreements. These project-specific terms will supersede this general policy.

  • Suspension of Services: Tesberry reserves the right to suspend or terminate services if the client fails to meet payment obligations or breaches any other material terms of the Service Agreement. In such cases, no refunds will be issued for services already rendered or committed resources.

 

3. Refund Policy:

  • Eligibility for Refund:

    • Within Initial Cancellation Window (7 days): If a valid cancellation request is received within the initial seven (7) calendar days, clients may be eligible for a refund. The refund amount will be calculated after deducting any direct costs incurred by Tesberry for services rendered, including but not limited to:

      • Initial consultation fees (if separately charged)

      • Discovery and requirements gathering efforts

      • Solution architecture and design

      • Resource allocation and setup costs

      • Any third-party expenses or licensing fees already paid on behalf of the client.

    • No Refund Post-Approval/Delivery: Once key project milestones have been approved by the client, or a significant portion of the service has been delivered, or the project has entered the deployment phase, refunds will generally not be applicable.

    • Non-Refundable Deposits/Phases: Certain projects may require a non-refundable upfront deposit or payment for specific phases (e.g., discovery phase, architectural design). Such non-refundable amounts will be clearly stipulated in the Service Agreement and will not be eligible for refund upon cancellation.

    • Service Discontinuation by Tesberry: In the unlikely event that Tesberry Pvt Ltd discontinues a service or project for reasons not attributable to client breach, clients will be refunded for any unutilized services or pre-paid amounts for work not yet delivered, on a pro-rata basis.

  • Refund Processing:

    • All eligible refunds will be processed within five (5) business days from the date the cancellation is confirmed and the final refund amount is determined.

    • Refunds will be issued using the same payment method used for the original transaction, wherever feasible.

    • Clients will be provided with a detailed breakdown of any deductions made from the refunded amount.

 

4. Exceptions and Disputes: Any disputes regarding cancellation or refund amounts will be addressed in accordance with the dispute resolution mechanism outlined in our Terms & Conditions and the specific Service Agreement. We encourage open communication to resolve any concerns amicably.
